Terms of use

1. Acceptance of these terms
Social Breathalyzer ("the tool") is a research tool operated by Sokolove Law, LLC ("Sokolove Law", "we", "us", "our"). By using the tool — including completing the intake form, uploading any file, or viewing your report — you agree to these terms and to the privacy notice referenced from them. If you do not agree, do not use the tool.
2. Eligibility
You must be at least 18 years old to use the tool. The tool is intended for residents of the United States; we make no claim about its suitability for use in other jurisdictions and do not actively support international participants.
3. Acceptable use
You agree that you will not:
- Upload any file that is not your own personal social media activity export;
- Upload data that belongs to a third party, even with their stated permission, unless you have a documented legal basis for processing that third party's data through this tool (you do not — the tool is designed for first-person use only);
- Attempt to circumvent, probe, or test the security of the tool, including by submitting forged tokens, attempting authentication bypass, or running automated scrapers against any endpoint;
- Submit material that is unlawful, defamatory, or that infringes any third party's intellectual property rights;
- Use the tool to harass any individual or to gather information about anyone other than yourself.
We reserve the right to refuse service, block uploads, and permanently delete data we suspect was uploaded in violation of these terms.
4. Not medical advice
Your screen-time report is descriptive — it tells you how many minutes per day your activity logs say you spent on a given platform. It is not diagnostic. The tool is not a substitute for professional advice from a physician, psychologist, therapist, or other qualified health practitioner. If your screen-time numbers concern you, consult someone qualified to help you act on them.
5. Not legal advice; no attorney-client relationship
Use of the tool does not create an attorney-client relationship between you and Sokolove Law or its co-counsel firms. Nothing in your report, in any email we send you, or on this site constitutes legal advice. If you believe you have a legal claim related to social media use, contact a qualified attorney directly; the contact form on sokolovelaw.com is the appropriate channel for inquiring about Sokolove Law's representation, separate from anything you do here.
6. Aggregate publication
Sokolove Law may reference de-identified, aggregate findings from this tool publicly — for example, "the median Social Breathalyzer participant in their twenties spent X minutes per day on TikTok in 2026." Aggregate publications will never identify any individual participant, will never include any field that could re-identify a participant in combination, and will never include your name, email, phone number, or state-and-age combination if doing so would risk re-identification (e.g. small-cell suppression for any group with fewer than five participants). The privacy notice describes this in more detail.
7. Right to suspend or terminate
We may suspend or terminate the tool — in whole, in part, or for any individual participant — at any time, for any reason or for no reason, with or without notice. If we shut the tool down, we will make a reasonable effort to email registered participants beforehand and to provide a final opportunity to download a copy of any report. We are not obligated to do so and you should not rely on continued availability.
8. Limitation of liability
The tool is provided "AS-IS" and "AS-AVAILABLE" without warranties of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Sokolove Law makes no warranty that the tool will be uninterrupted, secure, or error-free, that the report computations are accurate or complete, or that the underlying platform-supplied activity logs accurately reflect your behavior.
To the maximum extent permitted by applicable law, in no event will Sokolove Law, its parent, its co-counsel firms, or any of their respective directors, officers, employees, or contractors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the tool — even if we have been advised of the possibility of such damages. Where this limitation is unenforceable, our aggregate liability to you is limited to one hundred United States dollars (US$100).
9. Indemnification
You agree to indemnify and hold harmless Sokolove Law and its affiliates from any claim or demand, including reasonable attorneys' fees, made by any third party arising out of (a) data you uploaded that did not belong to you, (b) your violation of these terms, or (c) your violation of any law or the rights of any third party.
10. Governing law and venue
These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms or your use of the tool will be brought exclusively in the state or federal courts located in Suffolk County, Massachusetts, and you consent to the personal jurisdiction of those courts.
11. Changes to these terms
We may update these terms from time to time. Material changes will be highlighted on this page and dated. Continued use of the tool after the effective date of an update constitutes acceptance of the updated terms. If you do not agree, delete your data via the methods described in the privacy notice.
